Liberty Dollar Update IV

I put a motion into the civil forfeiture case over a year ago, but I was never served with the order that the court issued. The other day I opened a Pacer account and was looking for what the court ordered in the "warrant" case (which I've been reporting here,) and I found the order of the court in the "forfeiture" case.

I found that the judge basically denied my motion for the same reason he denied my motion for an order to show cause because he thinks it is frivolous that I am requesting a hearing in the matter. These denials tell me that they do not wish to hear anything that I have to say or give me any remedy through the federal courts.

My conclusion is that I have no remedy in the federal court, which makes sense if one views the Constitution as a separate court from the federal or appellate authority. Instead, remedy should lie in the judicial power, which is the Article III Court designated in the Constitution.

It's becoming clear that maybe I should inform the people at the Liberty Dollar about my little "investigation by filing", because they may be able to learn some things from the orders the judge has written in regard to my motions. I'll keep you posted.

Liberty Dollar Update III

I said I would let everyone know about the progress of my little escapade regarding the "Liberty Dollar" in the federal court of North Carolina. I asked the Federal Court to reconsider my motion to quash and the Magistrate came back with "it is well settled law...."

I decided, due to the situation in this particular case, that I would take a totally different approach to getting heard. I have already began the process, but it may take a little time since I'm not an expert in this kind of stuff.... at least not self-appointed.

I think the main point to remember here is that I'm basically trying to get a hearing which I believe I have a right to (see the Fifth Amendment). At this point it doesn't matter if I can win the case or not, but I won't be able to find out unless I get a hearing. So we are boiling this process down to the Right to he heard. That Right is in the First Amendment where it says, "... to petition the government for a redress of grievances."

Most people misunderstand the 'petition' process, and think that it goes to Congress or the federal government, when this is the general idea, the specific process of 'petition' for purposes of obtaining a remedy, is "a formal application to a court requesting judicial action on a certain matter." If you read the next paragraph for the definition of petition in Black's Law, you just might come to the realization that this process may very well be the remedy we have been looking for all this time.

Liberty Dollar Update II

As mentioned in the previous Liberty Dollar Update, the U.S Attorney alleged that I did not have "standing" to challenge the Seizure of the property. In the Order denying my motion, the Magistrate pointed out that I did claim an interest in the property, however he noticed that I did not say that I expected a privacy right at the location where the Warrants were served. I still haven't figured out why he would interject a "privacy right" where no right was needed or available. He denied the motion with prejudice, which means no trying again on that, and he commented that he didn't like my use of such "harsh words" when I gave my "opinion" of the officers investigation.

Although it appears that I have been precluded from proceeding in this particular matter and the Magistrate advises me to pay close attention to the Forfeiture and Criminal cases, I still have a few options that I believe may give a remedy. I'll be working on this for the next couple weeks and will keep everyone posted with the results. It not over yet!

Liberty Dollar Update

Back in November of 2007 the F.B.I. raided four locations belonging to the Liberty Dollar around the country and seized thousands of pounds of copper, thousands of ounces of silver, and many ounces of gold, plus a quarter million dollars in cash. The 'feds' then began a civil forfeiture action in 2008 and a criminal action in 2009. They proceeded to 'bury' the criminal defendants with 1.5 million documents to force the defense to waive the speedy trial rule and take many months to sift through the paperwork in order to create a defense.

On April 15, 2010 I sent into the federal court in North Carolina a motion to quash the four warrants that were issued against the Liberty Dollar back in November of 2007. The court unsealed the case and gave the United States ten (10) days to respond to my motion. Last Monday the attorney for the U.S. sent over his response requesting the court deny my motion. Thursday morning (4-28-10) the Court received my reply to the U.S.'s response and we are now waiting for the ruling. As soon as I hear, I will let everyone know.

Attorneys Are Liars

I know most people know this to be true, I just have to remind everyone that not only is it true, it is a very dangerous fact. It is dangerous because many who want to learn to defend their rights, will inevitably go to an attorney for advice. The attorney will lie about any issue of law.

The day before court, my friend Shawn (not her real name) got a hold of her public defender on the phone. She was asking the attorney what he was going to do for her and when he kept telling her she didn't have a chance to win, she asked if he was going to quit. He said no....

Back in Action

It's a few days after returning from the Campaign for Liberty in Minneapolis, Minnesota, and I'm still very excited and charged up. A few people said they got to watch the convention on C-SPAN, which covered the whole evening except the last singer, Sarah Evens.

There was over a thousand people all supporting Ron Paul and the Campaign for Liberty. It was extremely exciting and we met lots of people from all over that were just as excited as we were.

Rally Report

Hi everyone,

I'm here in Minneapolis and we just got back from The Nation Celebration, a concert that Ron Paul came to at at the end of at about 10:00 p.m., and got everyone fired up. He wants the Campaign to continue for the next few months at full throttle because he said we don't have much time, he believes the Neocons are planning to go to war.

This morning we went to the book signing where we lined up at Borders Bookstore in a mall that was filled 90% with Ron Paulers. He sat for 2 hours signing books and shaking hands. Wow, it was really exciting! Lots of people from all over the States. They drove, walked, and flew in, and are still continuing to do so. Even our hotel, which is 30 miles North of Minneapolis, still has Ron Pauler's rolling in.

It's difficult to figure if we can live stream in the convention center, However, I'll do my best to keep everyone informed of our progress.

Politics and Judicial Activism

Excerpted here is a paragraph of Ron Paul's writing on August 15, 2005 entitled, Politics and Judicial Activism:

"The public also plays a role in the erosion of our judiciary. Since many citizens lack basic knowledge of our Constitution and federalist system, they are easily manipulated by media and academic elites who tell them that judges are the absolute and final arbiters of US law. But the Supreme Court is not supreme over the other branches of government; it is supreme only over lower federal courts. If Americans wish to be free of judicial tyranny, they must at least develop basic knowledge of the judicial role in our republican government. The present state of affairs is a direct result of our collective ignorance."

This whole paragraph says a lot, however this one statement really grabs my attention, "If Americans wish to be free of judicial tyranny, they must at least develop basic knowledge of the judicial role in our republican government".

This development of "basic knowledge" is the price of freedom. It takes individual participation, education, power, a new perspective, and the eternal vigilance that Thomas Jefferson talked about. This is the price we each must pay to redeem our freedom and liberty.

Whoa! What a year this has been. And what achievements we have had. If I may quote Trotsky of all people, this Revolution is permanent. It will not end at the Republican convention. It will not end in November. It will not end until we have won the great battle on which we have embarked. Not because of me, but because of you. Millions of Americans -- and friends in many other countries -- have dedicated themselves to the principles of liberty: to free enterprise, limited government, sound money, no income tax, and peace. We will not falter so long as there is one restriction on our persons, our property, our civil liberties. How much I owe you. I can never possibly repay your generous donations, hard work, whole-hearted dedication and love of freedom. How blessed I am to be associated with you. Carol, of course, sends her love as well.

Let me tell you my thoughts. With Romney gone, the chances of a brokered convention are nearly zero. But that does not affect my determination to fight on, in every caucus and primary remaining, and at the convention for our ideas, with just as many delegates as I can get. But with so many primaries and caucuses now over, we do not now need so big a national campaign staff, and so I am making it leaner and tighter. Of course, I am committed to fighting for our ideas within the Republican party, so there will be no third party run. I do not denigrate third parties -- just the opposite, and I have long worked to remove the ballot-access restrictions on them. But I am a Republican, and I will remain a Republican.

I also have another priority. I have constituents in my home district that I must serve. I cannot and will not let them down. And I have another battle I must face here as well. If I were to lose the primary for my congressional seat, all our opponents would react with glee, and pretend it was a rejection of our ideas. I cannot and will not let that happen.

In the presidential race and the congressional race, I need your support, as always. A Miraculous Success

I have been voting for the freedom candidate since 1980 (Ed Clark), including Ron Paul in '88. They all lost. And I guess having my candidate lose every year was not ENOUGH loss for me so I ran for congress myself on the Libertarian ticket. And lost. Hahahaha! Did you really think we could just waltz in and take over the country? Without a fight? Sorry, but turning a ship 180 degrees takes time, especially when lots of powerful people are fighting you.

For those of us who have been fighting for liberty for more than the last few months, Ron Paul's 2008 campaign is a miraculous success. Almost overnight, a powerful Nationwide organization has formed around Ron Paul. It very well may propel him to the White House, but even if it doesn't, the fight for liberty has been advanced dramatically - beyond anything I thought would happen in my lifetime - and will continue to grow and spread. We have reached critical mass now.

Our job is to educate our countrymen. Right now the best vehicle for that is the Ron Paul 2008 campaign. Even if RP wins the White House in 08, we will STILL have a huge job to do. In fact, our job will be the same either way - to educate our community and elect freedom-loving representatives. Having RP in the "bully pulpit" of the Presidency will be an enormous aid, but we will still be in a battle on the streets.

Quit if you must. Maybe it doesn't matter much to you. Maybe this was just a lark for you. Maybe you don't have children. Maybe you don't care about our posterity. Maybe you will not be ashamed at handing over a bankrupt dictatorship to the next generation.

As for me, there is no place to go but onward with the fight.

An Appeal to Republicans

The Republican party says it's for lower taxes. It isn't. It passed the largest federal budget in history, and even after it controlled the White House and both houses of Congress, it failed to make a dent in the federal tax burden.

The Republican party says it's for limited government. It isn't. Not only has it failed to reduce the already ridiculous size and power of government, it has drastically increased it.

The Republic party says it's for individual liberties. It isn't. It created the biggest federal bureaucracy in history, and gave it all sorts of new powers to spy on, detain, silence, and otherwise harass Americans.

The Republican party says it believes in the Constitution. It doesn't. It has done absolutely nothing to try to correct the mangling of the "commerce clause" to allow the federal government to stick its nose in everyone's business.

And when someone came along who really IS for lower taxes, limited government, individual liberty, and a return to the Constitution, how did the Republican establishment respond? By smearing, demonizing, demeaning, marginalizing, and insulting him, and trying to silence him. Even though that man is a Republican.

My question is, just how stupid are Republican voters? Just how badly and how often do you need to be betrayed by the totalitarians in the GOP (masquerading as "limited government" advocates) before you stop SUPPORTING their collectivist crap?

"But the Democrats are even worse!"

No, they aren't. They are IDENTICAL. The only difference is in their rhetoric: the Republicans pander to those who want limited government, and the Democrats pander to those who want the nanny state to control and take care of everything. But in action, the two are THE SAME. They are two faces of ONE group of power-happy, war-mongering, fear-mongering, liberty-destroying nationalist/socialists. The suggestion that THOSE are your only choices is a classic tyrant trick. Unfortunately, almost all Americans still fall for it.

Personally, I don't believe in "limited government" any more than I believe in "limited murder," "limited rape," or "limited armed robbery." But for those "limited statists" out there who still believe in the Constitution, stop supporting its demise! If you must vote, and Ron Paul loses the Republican primary--which the Republican establishment is going to great lengths to ensure--vote for him anyway. I don't care whether he runs or not. Write in his name. If instead you hold your nose and vote for the establishment- appointed collectivist, YOU are the problem.

Yes, I am telling you to intentionally destroy the Republican party, because it is an absolute fraud. Of course, the Democratic power machine is equally fraudulent and evil, but by supporting either of them--instead of telling them BOTH to go to hell--you are ENABLING your own enslavement. Quit bickering over which crook is worse, and just STOP SUPPORTING CROOKS. "But then the OTHER guy will win!" So what? I would wager that NO ONE could tell, based only on the legislation passed during the Clinton administration as compared to that passed during the Bush administration, who was on the "left" and who was on the "right." The result is always the same: more power for them, less freedom for you. By supporting EITHER party, you prolong the lie, and assist in your own subjugation.

There is only one person running for President who actually believes in the Constitution, and look how hard his "own" party is trying to silence him. And look who they have running AGAINST him: several left-leaning, tax-and-spend socialists (Huckabee, Romney, McCain and Giuliani). Every one of them is far left of JFK! Is that really what "conseravtives" want? Who exactly is the Republican party "representing"?

Anyone with their eyes open can see that the Republican establishment doesn't CARE what Republican VOTERS want. They are still trying to milk the reputation of Ronald Reagan, while viciously slandering anyone who sounds anything like him. They are just as elitist as the Democrats, having nothing but contempt for your freedom and what YOU want. When thousands of you said "We want Ron Paul!" what did the Republican establishment say? "To hell with you!" Well, it's high time to return the compliment. Maybe the best thing to come out of a Ron Paul presidential run will be a long overdue unmasking and discrediting of the totalitarian elitists club calling itself the Republican party.

Monetary Policy is Critically Important

Federal Reserve Chairman Ben Bernanke testifies twice every year before the congressional Financial Services committee, and I look forward to these opportunities to raise questions about monetary policy. I believe monetary policy is critically important yet overlooked in Washington. Money is the lifeblood of any economy, and control over a nation's currency means control over its economic well being. Fed bankers quite literally determine the value of our money, by controlling the supply of dollars and establishing interest rates. Their actions can make you richer or poorer overnight, in terms of the value of your savings and the buying power of your paycheck. So I urge all Americans to educate themselves about monetary policy, and better understand how a small group of unelected individuals at the Federal Reserve and Treasury department wield tremendous power over our lives.

The following are some excerpted comments from my opening remarks at the hearing with Mr. Bernanke:

Transparency in monetary policy is a goal we should all support. I've often wondered why Congress so willingly has given up its prerogative over monetary policy. Astonishingly, Congress in essence has ceded total control over the value of our money to a secretive central bank.

Congress, although not by law, essentially has given up all its oversight responsibility over the Federal Reserve. There are no true audits, and Congress knows nothing of the conversations, plans, and actions taken in concert with other central banks. We get less and less information regarding the money supply each year, especially now that M3 is no longer reported.

The role the Fed plays in the President's secretive Working Group on Financial Markets goes unnoticed by members of Congress. The Federal Reserve shows no willingness to inform Congress voluntarily about how often the Working Group meets, what actions it takes that affect the financial markets, or why it takes those actions.

But these actions, directed by the Federal Reserve, alter the purchasing power of our money. And that purchasing power is always reduced. The dollar today is worth only four cents compared to the dollar in 1913, when the Federal Reserve started. This has profound consequences for our economy and our political stability. All paper currencies are vulnerable to collapse, and history is replete with examples of great suffering caused by such collapses, especially to a nation's poor and middle class. This leads to political turmoil.

Government officials consistently claim that inflation is in check at barely 2%, but middle class Americans know that their purchasing power--especially when it comes to housing, energy, medical care, and school tuition-- is shrinking much faster than 2% each year.

We look at GDP numbers to reassure ourselves that all is well, yet a growing number of Americans still do not enjoy the higher standard of living that monetary inflation brings to the privileged few. Those few have access to the newly created money first, before its value is diluted.

For example: Before the breakdown of the Bretton Woods system, CEO income was about 30 times the average worker's pay. Today, it's closer to 500 times. It's hard to explain this simply by market forces and increases in productivity. One Wall Street firm last year gave out bonuses totaling $16.5 billion. There's little evidence that this represents free market capitalism.

In 2006 dollars, the minimum wage was $9.50 before the 1971 breakdown of Bretton Woods. Today that dollar is worth $5.15. Congress congratulates itself for raising the minimum wage by mandate, but in reality it has lowered the minimum wage by allowing the Fed to devalue the dollar. We must consider how the growing inequalities created by our monetary system will lead to social discord.

How can a policy of steadily debasing our currency be defended morally, knowing what harm it causes to those who still believe in saving money and assuming responsibility for themselves in their retirement years? Is it any wonder we are a nation of debtors rather than savers?

We need more transparency in how the Federal Reserve carries out monetary policy, and we need it soon.
