Understanding Sovereignty

Political Power can be exercised by voting for representatives to take up space in the legislative or executive branches of government, however it may also be established by personal action taken through the Judicial branch of government by conducting the "One Supreme Court". This is done by exercising sovereignty or controlling the "due process" and "equal protection of the laws" guaranteed by the Constitution. CALIFORNIA CONSTITUTION ARTICLE 6 JUDICIAL SEC. 1. "The judicial power of this State is vested in the Supreme Court, courts of appeal, superior courts, and municipal courts. All courts are courts of record.

SEC. 2. The Supreme Court consists of **the Chief Justice** of California and 6 associate justices. The Chief Justice may convene the court at any time. Concurrence of 4 judges present at the argument is necessary for a judgment.

**An acting Chief Justice** shall perform all functions of the Chief Justice when the Chief Justice is **absent or unable to act**. The Chief Justice or, if the Chief Justice fails to do so, the court shall select an associate justice as acting Chief Justice."

To stay separate, each individual must exercise the Judicial power using the position of the Chief Justice as described in the California Constitution, or be "subject" to the Legislative and Executive power. Article III of the Constitution is the Judicial Power, and it is the court extending to all cases, law and equity... **JUDICIAL POWER** Section 1. The judicial power of the United States shall be vested in **ONE SUPREME COURT**...

Section 2.  The judicial power shall extend to all cases, in **law and equity**, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;...

What is a court? "The person and the suit of the sovereign; the place where the sovereign sojourns with his regal retinue, wherever that may be." What is sovereignty? "Paramount control of the constitution and frame of government and its administration: the self sufficient source of political power." What is political? "Pertaining to or relating to the policy or the administration of government, state or nation. When observing the court, we find the prosecuting attorney claiming to represent the code or statute that has been enacted by the legislative power. The judge or magistrate sitting in the executive power, and the defendant, you in the judicial power... the Constitution coming alive in the court! Constitutional Rights are not public, not private, but PERSONAL. This is what allows each individual to be sovereign, and have the power to give up their rights, by silence. ]]>

Freedom and Liberty are PERSONAL attributes. They are defended by the Individual through the exercise of Judicial Power in the Court. This means that every interaction between you and any government agent is by one of two process. Either you proceed by Roman statutory or English common law. Welcome to life and the court.... prima facie. Exercising freedom and liberty takes knowledge of how to defend free action, which are otherwise known as RIGHTS. The fact that these rights are protected by the same people who are violating them is pretty intimidating. This is why it is imperative that we be prepared and able to perform. This can start with watching and learning court procedures and studying how the Common law system works. Yes the government needs to be cleaned up.... and there is only ONE person who can do that. It's going to take some learning about words and their power, the court system, the common law, and a whole lot of SELF reliance, inner game, and emotion.]]>

To Talk or Not to Talk?

The Constitutional government gives you the right to free speech, to talk freely, to defend your right to talk or defend any other free action. The words you speak show you are "exercising" your right to defend yourself. No words, no defense! The corporate government gives you the right to NOT talk, the right to remain silent. "The right to remain silent is the right to NOT talk or NOT take action or NOT defend your right. By exercising the right to NOT take action, you are in fact "waiving" your right to talk. Remaining silent, or "waiving" your right to talk or defend, gives rise to the ASSUMPTION that because you are not defending, you are agreeing that the charges are true, otherwise you would have defended or exercised your right to defend. The constitution is the defense or restraining order on all government, by requiring a warrant or order to search or seize. You must talk to get the agents and get them to recognize your constitutional right, guaranteed by the Fourth Amendment, and have them respect that right.

REMAIN SILENT; DON'T TAKE THE LAW INTO YOUR OWN HANDS

If you believe that this is the proper action of a free person then you have a lot of brainwashing and training to overcome as this is a major problem and epidemic among the people for whom the U.S. Constitution was written. The above two "slogans" are total propaganda and made up by the "ruling elite" so that the people will be led by media and miss-information to conform to the "ruling elite's" program. This program is the corporate or federal laws that have been designed to take control of each individual's life. If you do not believe me, read the two slogans again. Who says one should "remain silent".....the attorneys, judges, and media; all government agents? Why would they want us to remain silent? When one remains silent, it is an indication of guilt!!!!! That's correct. An innocent person would immediately begin the dialog to evidence the fact that no real crime was committed. An innocent person would immediately present their "restraining order" to the government agent to prevent the agent from proceeding under corporate or federal Law and make up a crime against the individual. One cannot do this if they remain silent. If one doesn't take the law into their own hands by requiring the agent to follow the national governmental process, i.e. the Constitution, then the agent will automatically proceed by the federal corporate laws and impose his rules upon the individual who failed to bind the agent to the National Constitution. Believe it or not, every agent of government who has the power to "enforce" the law, takes an oath to uphold each of our Constitutional rights! But only if the individual requires the agent to abide by that oath at the scene, with them... personally. The Constitution is the supreme law of the land, and only available "personally" and "on demand". You can't get your Constitutional rights if you remain silent. If you remain silent, you can't take the law into your own hands, and thus you will NOT receive your Constitutional Rights.

Excerpted here is a paragraph of Ron Paul's writing on August 15, 2005 entitled, [Politics and Judicial Activism](http://www.ronpaul2008.com/articles/899/politics-and-judicial-activism/):

"The public also plays a role in the erosion of our judiciary. Since many citizens lack basic knowledge of our Constitution and federalist system, they are easily manipulated by media and academic elites who tell them that judges are the absolute and final arbiters of US law. But the Supreme Court is not supreme over the other branches of government; it is supreme only over lower federal courts. If Americans wish to be free of judicial tyranny, they must at least develop basic knowledge of the judicial role in our republican government. The present state of affairs is a direct result of our collective ignorance."

This whole paragraph says a lot, however this one statement really grabs my attention, "If Americans wish to be free of judicial tyranny, they must at least develop basic knowledge of the judicial role in our republican government". This development of "[basic knowledge](/about.php)" is the price of freedom. It takes individual participation, education, power, a new perspective, and the eternal vigilance that Thomas Jefferson talked about. This is the price we each must pay to redeem our freedom and liberty.

If I may quote Trotsky of all people, this Revolution is permanent. It will not end at the Republican convention. It will not end in November. It will not end until we have won the great battle on which we have embarked. Not because of me, but because of you. Millions of Americans -- and friends in many other countries -- have dedicated themselves to the principles of liberty: to free enterprise, limited government, sound money, no income tax, and peace. We will not falter so long as there is one restriction on our persons, our property, our civil liberties. How much I owe you. A Miraculous Success

They all lost. And I guess having my candidate lose every year was not ENOUGH loss for me so I ran for congress myself on the Libertarian ticket. And lost. Hahahaha! Did you really think we could just waltz in and take over the country? Without a fight? Sorry, but turning a ship 180 degrees takes time, especially when lots of powerful people are fighting you. For those of us who have been fighting for liberty for more than the last few months, Ron Paul's 2008 campaign is a miraculous success. Almost overnight, a powerful Nationwide organization has formed around Ron Paul. It very well may propel him to the White House, but even if it doesn't, the fight for liberty has been advanced dramatically - beyond anything I thought would happen in my lifetime - and will continue to grow and spread. We have reached critical mass now. Our job is to educate our countrymen. Right now the best vehicle for that is the Ron Paul 2008 campaign. Even if RP wins the White House in 08, we will STILL have a huge job to do. In fact, our job will be the same either way - to educate our community and elect freedom-loving representatives. Having RP in the "bully pulpit" of the Presidency will be an enormous aid, but we will still be in a battle on the streets. Quit if you must. Maybe it doesn't matter much to you. Maybe this was just a lark for you. Maybe you don't have children. Maybe you don't care about our posterity. Maybe you will not be ashamed at handing over a bankrupt dictatorship to the next generation. As for me, there is no place to go but onward with the fight.
